Welcome to HEDA. These Terms of Service ("Terms") govern your access to and use of the HEDA platform, website, desktop application, and related services (collectively, the "Service") operated by StackSmiths Private Limited ("we", "us", "our"), a company registered in Rajasthan, India.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
When you purchase a subscription or credits through the Service, your payment is processed by Paddle. By completing a purchase, you agree to Paddle's Terms of Use and Privacy Policy. All prices are displayed inclusive of applicable taxes unless stated otherwise. Paddle handles currency conversion, sales tax, and VAT where required.
To use the Service, you must create an account by providing accurate and complete information. You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
We offer a 7-day free trial with 100 complimentary credits. A valid payment method is required to start the trial, but you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically activate and your payment method will be charged. You may cancel at any time during the trial at no cost.
HEDA offers subscription plans that include a monthly credit allocation. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. Credits are consumed when running engines or sending messages. Unused credits from monthly allocations do not roll over unless specified in your plan.
You agree to use the Service only for lawful purposes. You shall not:
The Service, including its design, code, algorithms, brand assets, and documentation, is the exclusive property of StackSmiths Private Limited. You retain ownership of your data and any content you create through the Service. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you.
Your use of the Service is also governed by our Privacy Policy. We process personal data in accordance with applicable data protection laws. You are responsible for ensuring that your use of lead data obtained through the Service complies with applicable laws in your jurisdiction.
We offer a 30-day money-back guarantee on all paid subscriptions, subject to credit usage. Please see our Refund Policy for full details. Since Paddle is the Merchant of Record, refund requests are processed through Paddle.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and third-party services (search engines, email providers, etc.) may experience downtime outside our control. We are not liable for any losses arising from temporary unavailability.
To the maximum extent permitted by law, StackSmiths Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
You may cancel your account at any time. We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Rajasthan, India.
